Step 5— Immigrant Visa Application or Adjustment of Status

Upon approval of the I-526 Petition,

a. If you are in the United States, you may apply for “Adjustment of Status to Conditional Resident Status”. At this point, you will apply for a Green Card through CIS. No interview is customarily required. Adjustment of status is a procedure that allows an eligible applicant to become a lawful permanent resident of the United States without having to go abroad and apply for an immigrant visa.

b. If you are abroad, you must wait for notification from the National Visa center to prepare documents for the Immigrant Visa interview at the U.S. Consulate or Embassy in your home country. Once approved as an eligible EB-5 investor you will be sent an instruction packet for your Immigrant Visa Application (Forms DS-2001 & DS 230i). You must review the information in this packet and complete the forms prior to scheduling of your U.S. visa interview. After receipt of your completed Immigrant Visa Application, you will be notified by the U.S. Consulate of your formal interview date. At this time, you will also receive an Appointment Package for Immigrant Visa Applicants (DS-230ii), and you will be required to complete a medical examination.

The purpose of the Adjustment of Status or Immigrant Visa interview is to ensure you are not subject to exclusion on the grounds of a criminal past, infectious diseases, or anything else which might prevent you from becoming an immigrant to the US.
